1. Acceptance of Terms

By accessing or using Ganapio (“the Platform”), operated at www.ganapio.com, you agree to be bound by these Terms of Service (“Terms”). If you do not agree, do not use the Platform. These Terms constitute a legally binding agreement between you and Ganapio.

2. Description of Service

Ganapio is a digital goods marketplace that enables creators (“Sellers”) to list, sell, and deliver digital products including ebooks, online courses, templates, software, and other digital content to customers (“Buyers”). We provide the platform infrastructure, payment processing (via Razorpay), file delivery, and analytics tools.

3. Account Registration

  • You must be at least 18 years old to create an account.
  • You must provide accurate and complete information during registration.
  • You are responsible for maintaining the security of your account credentials.
  • You must notify us immediately of any unauthorised access to your account.
  • One person or entity may not maintain more than one Seller account without prior approval.

4. Seller Obligations

As a Seller on Ganapio, you agree to:

  • Only list products that you have the legal right to sell and distribute.
  • Provide accurate descriptions and representations of your products.
  • Deliver the product as described after a successful purchase.
  • Comply with all applicable Indian laws, including the Consumer Protection Act, 2019, the Information Technology Act, 2000, and the Digital Personal Data Protection Act, 2023.
  • Not list products that contain malware, infringe intellectual property, promote illegal activities, or contain harmful or misleading content.
  • Handle buyer inquiries and support in a timely manner.

5. Buyer Rights and Obligations

  • By purchasing a product, you receive a non-exclusive, non-transferable license to use the digital product for personal or permitted commercial use as specified by the Seller.
  • You may not redistribute, resell, or share purchased products unless explicitly allowed by the Seller's license terms.
  • You agree not to use purchased products for unlawful purposes.

6. Payments and Fees

  • All payments are processed through Razorpay in Indian Rupees or other currencies as supported by Razorpay.
  • Supported payment methods include UPI, credit/debit cards, net banking, and digital wallets.
  • Ganapio charges a platform fee on each transaction as described on our pricing page. Early access creators receive special fee structures.
  • Seller payouts are processed to the bank account linked to their Razorpay account, subject to Razorpay's settlement timeline (typically T+2 business days).
  • All prices displayed on the Platform are inclusive of applicable taxes or fees unless stated otherwise.

7. Refund Policy

Due to the digital nature of the products sold on Ganapio, refunds are handled on a case-by-case basis. Sellers may set their own refund policies for their products. If a product is materially different from its description, Buyers may request a refund by contacting the Seller directly or reaching out to Ganapio support. Ganapio reserves the right to mediate disputes and issue refunds when warranted.

8. Intellectual Property

  • Sellers retain all intellectual property rights to their products.
  • By listing a product, Sellers grant Ganapio a non-exclusive, royalty-free license to display, distribute, and promote the product on the Platform.
  • The Ganapio name, logo, and platform design are the property of Ganapio and may not be used without permission.

9. Prohibited Content

The following types of content are prohibited on Ganapio:

  • Content that infringes copyright, trademark, or other intellectual property rights.
  • Malware, viruses, or any harmful software.
  • Illegal content under Indian law.
  • Content that promotes violence, discrimination, or hate speech.
  • Fraudulent or misleading products.
  • Adult or sexually explicit content.

Ganapio reserves the right to remove any content that violates these restrictions and to suspend or terminate the associated account.

10. Limitation of Liability

Ganapio provides the Platform on an “as is” and “as available” basis. To the maximum extent permitted by Indian law, Ganapio shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of the Platform. Our total liability for any claim shall not exceed the fees paid by you to Ganapio in the twelve (12) months preceding the claim.

11. Account Termination

We may suspend or terminate your account if you violate these Terms, engage in fraudulent activity, or upon your request. Upon termination, your right to use the Platform ceases immediately. Any pending payouts will be processed according to our standard settlement schedule, subject to any holds for dispute resolution.

12. Governing Law and Disputes

These Terms are governed by and construed in accordance with the laws of India. Any disputes arising from these Terms or your use of the Platform shall be subject to the exclusive jurisdiction of the courts in Delhi, India. Before initiating legal proceedings, parties agree to attempt resolution through good-faith negotiation for a period of 30 days.

13. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated via email or a prominent notice on the Platform at least 15 days before they take effect. Your continued use of Ganapio after changes take effect constitutes acceptance of the updated Terms.
